Swiss Reject U.S. Request to Extradite Polanski

Switzerland will not extradite the film director Roman Polanski to the United States to face charges of unlawful sex with a minor because of a possible fault in the American application for his extradition, Justice Minister Eveline Widmer-Schlumpf told a news conference on Monday.

“He’s a free man,” she said.

Mr. Polanski was arrested on an international warrant issued by the United States on charges dating from 1977. The director fled on the eve of sentencing in California because of fear that the presiding intended to renege what his defense lawyers said was a deal to avoid a prison sentence.

Ms. Widmer-Schlumpf said the American authorities had rejected a request by her ministry for records of a hearing by the prosecutor in the case, Roger Gunson, in January 2010, which should have established whether the judge who tried the case in 1977 had assured Mr. Polanski that time he spent in a psychiatric unit would constitute the whole of the period of imprisonment he would serve.

“If this were the case, Roman Polanski would actually have already served his sentence and therefore both the proceedings on which the U.S. extradition request is founded and the request itself would have no foundation,” the Swiss Justice Ministry said in a statement.

Polanski's actions in 19977 werecriminal and he should be in prison regardless of his talent/celebrity. He should not receive any special treatment or get off easy. This is a travesty of justice.

This is disgusting! He pleaded guilty so there is no question about it.
Instead of hounding MJ diane dimond, tom sneddon, etc should have gone after him.

Isn't it strange how only US seems to still hold him accountable?
Just think about it, the guy lived since the 70ies in Europe, traveled throughout Europe and the world (other than US) and no one seem to have been bothered by it; now Swiss is finally rejecting that extradition request made by guess who? The LADP!

No question that what he has done was definitely bad, but the whole story is still strange, you have to admit ...

Oh so thats how it works...Your 13 year old Daughter /sister gets drugged and raped.....but the years go by , and ,well it's no big deal... The " caught" rapists gets away with it...Bussiness as usual........Somehow methinks , MONEY TALKS......

He admitted to drugging and raping a 13 year old. I can't imagine anyone making a deal with him to avoid prison time. The swiss are protecting a child rapist – if that is all they care about their own children then I thank God I'm not swiss. He is not a free man he's a free pedophile.

@Jan. My thoughts too, but MJ was BLACK remember?. That's the whole issue here. The fact that he was PROVEN innocent and acquitted by a jury of 12 (with no blacks) doesn't matter, they keep trashing him even after death and are now hunting down his children. These hypocrites make me SICK. I mean, falsely accusing MJ of child molestation, but finding excuses for a WHITE RAPIST who confessed and was convicted and fled the country. This is so UNFAIR.

The swiss refused to name all the american tax dodgers who have accounts in swiss banks. Our government just took it.
Now they refuse to extradite a convicted child raper.

Is is not time to get though with that little country and hit them where they hurt the most, in their bank accounts. We could swing a mighty hammer if our government had the right size yoyo-s.

The word was out that a plea deal had been done for time served, but the judge was going to welch on that agreement. And the US authorities refused to turn over documents showing whether that was true. How could extradition be agreed to if the key documents showing if he already served his time were held back?

You don´t just rape and sodomize a 13 year old girl and expect to serve 42 days in a clinic and just go home!

That judge who may have said such a thing must have been paid off with a good amount of shekels, however our laws say something else.
