LKL – Will Elena Kagan get confirmed?

Why not? She is no less qualified and lacks no less experience
than some Supreme Court Chief justices nominated and
appointed by the Reagan Administration and other Republican
appointees. The only stumbling block I foresee is that
Republicans are putting a lot of pressure on her and on
President Obama to extort power from the present administration
and from the Democratic party. If she is appointed and something
really major you happen with adverse consequences in which she
werre the deciding vote; the Republican party and other
dissenting Democrats would say ; "I told you so that she was not
qualified due to lack of experience on the "bench." It is all
dirty politics. It is like some field commanders in the police
Dept. and in the army. The requirement is that they be battle
tested but some commanders and platoon leaders have done
better with less field experience but with more technical knowledge,
more intellect, more philosophical, psychological and sociological
knowledge of the field to which their were appointed.
There are some issues that I would like to know more about
Kegan such as her stance on gay rights and the issue of
separation of church from the state. I would not like her to be
too rigid or to condescending on either issue. A judge should not
be swayed by personal feelings on relevant issues before the
court. The rule of law should have room for merciful views
with compassionate links but not for bias and outright
prejudice which sometimes judges carry to the courtroom. A
judge that has extreme inner personal feelings about an issue
should disqualified him/herself from rendering an opinion that
may 250 million people in the future. These laissez -faire type
of judges like Justice Roberts and Justice Thomas have
permeatted the courts and the criminal justice system allowing
radical changes in the courts system, therefore impeding the
proper, fair, and impartial way in the administration of justice.
One nation indivisible with justice and liberty for all is sometimes
a myth perpetrated by those in charge of dispensing justice
but the motto could be used as a double edge sword like
the one being used in Arizona now to try circumvent fairness
and impartiality ( the main ingredients in the foundation of
liberty and justice for all).

There is a talk of she being a lesbian.
Ms. Kagan should come out and say it openly if she really is and stop all those rumors.
In Europe homosexuality is not a problem, after all we live in the 21st century. The secretary of state, the lord mayers of Berlin and Hamburg in Germany are practicing homos, as are several members of the parlament. The same is in GB.
Not to mention the Vatican, where you have to be one to be able to survive.

That 's was one of the issues I was attempting to clarify. If Judge
Kagan is a lesbian, or practices lesbian protectionism, she should
should come out and state her position . IShe has been professor
of professors at Harvard University which I believe makes her
overqualified for the job. All that we should ask of her is that
if she gets the job that she be impartial, fair and honorable.

Larry, of course Elena Kagan will be confirmed. The Republican-Tea Potty party of NO is not going to filibuster her nomination which is a straight UP or DOWN vote.

It’s not entirely impossible for Buracas Obama to have is way with Elean Kagan, and for those people like James Carville to cheer him on and callously look the other way.

Minus of course on all those other instances where their own butts are on the frying pan or being drowned in the gulf oil spill of course.

Longerst Serving Senator Dies
Sen. Robert Byrd was very much of his turbulent era and
a man of West Virginia, able to dramatically influence and
shape policy for more than half a century while bestowing
billions on his beloved state.

He died Monday after a short hospitalization in Washington's
Virginia suburbs.
He was the most nimble of politicians, a man who filibustered
the Civil Rights Act for more than 14 hours, but later became a
vocal , influential advocate for the underprivilieged.
An American politician, raised in hardscrabble Appalachian coal
country, a one time butcher and Ku Klux Klansman who rose to
become one of Washington's most powerful figures," according
to Nation and the World, McClatchy Newspapers, via St
Petersburg News.
Sen. Byrd grew with the times, and made a fairly radical
transformation, according to Jeremiah Mayer, an associate
professor of public policty at George Mason University in
Fairfax, Va,
On another level, he fiery Democrat was, as Senate
associates historian Don Ritchie put it," a real Senate institution
and an ubstutitional man," one who matered the nuances of
the chamber like no one of his era."
" I call him the Senate's most dependable authority on the
Constitution of the United States," said former Sen. George
McGovern, D.S,D. who served with Byrd from 1963 to 1981. It is
almostas if momorized the whole thing.

Sorry to take space about on this blog about Mr Byrd but
he was one of kind in the U.S. Senate.
He was born in 1917 in N.C. Hi smother died when he
was one(1) and he was raised by Titus and Vlurma Byrd recalled
were very poor as Titus worked in a coal mine in Southern
West Virginia. Robert Byrd graduated first in his high school class.
He enrolled in American University's law school during his
first year in Washington and graduated 10 years later.
Vice President Joe Biden recalled how, after he's just been
elected to the Senate from Delaware in 1972, and his wife
and young daughter were killed in a car accident a few weeks
later. Mr Byrd sat quetly in the back of the funeral service after
waiting two hours in the rain to get in. " He didn't even knew me,"
Biden recalled.

Mr Byrdx made his mark in more public ways, as bridge
between the slow Senate ways of doing business and
the 21st century. At the same time he wrote a four-volume history
of the Senate, rarely held televised news conferences and
frowned on Senators he caught using BlackBerrys on the Senate
floor.
Hel helped shepherd through Congress the notable
legislation of the day, the notable legislation of the day:
the 1978 Panama Canal;treaty, the 1978 tax -system overhaul,
among others.
" He was a one-man stimulus program fo the state of
West Virginia, Baker said, according to the St Petersburg

If Congress had the courage to pass an appropriation bill which cut the funding for the War and Occupation in Afghanistan, that would pressure the Pentagon to withdraw the US Military from Afghanistan as Congress did previously with the Viet Nam War many years ago.

What does it matter what Elena Kagan's sexual orientation is? You say you want her to come out and tell the world what her sexual orientation is to stop all the rumors? Kagan doesn't have a problem here, you are the problem, and your rude comments only add to the rumor mill. Using derogatory words calling homosexuals, "practicing homos" illustrates your own obsession with homosexuals and the need to fill your head with any rumor on the subject.
I think perhaps now is a good time in which you should confess to us of your own homosexual struggle and come out of the gay closet, so we can all move on to the actual topic of her confirmation hearings, not homophobic comments that has nothing to do with her ability to be a supreme court justice.

Were you shocked and surprised by your Pope expressing outrage over the Child sex abuse raid on a Belgian Catholic Church? Something like 500 criminal charges of sodomy, rape and child molestation.

And I'm pleased the US Supreme Court refused to prevent Oregon Courts from going after the Vatican and the Pope over the Pope's fanatic attempts to shield himself by diplomatic immunity and sovereign rights for his priests to rape, sodomize and molest Oregon's children. I would pay money to sit in on the jury!

I said that justice should be fair, impartial and honest.
There is no justice in blind justice. Justice shoud prevail
for all without a lynch posse. A jury cannot and should not be
be swayed to do what you would like it to do but it shall do

Calling someone a "homo" is not an internationally accepted way to refer to what you consider "an unnatural act," it is derogatory slang, and if you cannot understand that point, that is YOUR problem!

Just a little education for you:

What a person does in the bedroom is private and is none of your or my business, unless a person wishes to reveal their sexual orientation to someone else. Homosexuality is normal atypical behavior, not a "deviation from normal" as you've stated. Homosexual behavior is found in nature practiced by both animals and homo-sapiens. By the way, that is a proper use of the word!

You are correct, any private person has the right to do anything LEGAL in their bedroom without any interference from the public.

However, Ms. Kazan wants to be a Superior Judge and will make decisions that will effect our country for years if not centuries, therefore we the people have the right to know what makes her tick.
Our President is in power only 4 or 8 years and he will be investigated about everything in his private life. Why should she have the privilage of not to come clean on everything?

By the way, did you have a chance to visit the girls at Muscle Beach?
