States sue to block health care bill

Posted: 08:00 PM ET

(CNN) Officials from 14 states have gone to court to block the historic overhaul of the U.S. health care system that President Barack Obama signed into law Tuesday, arguing that the legislation's requirement that individuals buy health insurance violates the Constitution.

Thirteen of those officials filed suit in a federal court in Pensacola, Florida, minutes after Obama signed the Patient Protection and Affordable Care
Act. The complaint calls the act an "unprecedented encroachment on the sovereignty of the states" and asks a judge to block its enforcement.

"The Constitution nowhere authorizes the United States to mandate, either directly or under threat of penalty, that all citizens and legal residents have
qualifying health care coverage," the lawsuit states.

The case was filed by Florida Attorney General Bill McCollum and joined by 11 other Republican attorneys general, along with one Democrat. McCollum
said the new law also forces states "to do things that are practically impossible to do as a practical matter, and forcing us to do it without giving any resources or money to do it."

McCollum's lawsuit was joined by his counterparts in South Carolina, Nebraska, Texas, Utah, Louisiana, Alabama, Michigan, Pennsylvania, Colorado,
Idaho, South Dakota and Washington. Virginia's attorney general, Ken Cuccinelli, filed a separate case in his state Tuesday afternoon.

DR GARY   March 23rd, 2010 8:12 pm ET

THIS NATION SHOULD RISE UP AGAINST THIS. IF WE DON'T IT WILL BE MORE AND MORE GOVERNMENT IN OUR BUSINESS. WHY DO YOU THINK THERE ARE CAMERAS AT EVERY INTERSECTION. DO YOU REALLY THINK THOSE ARE ULTIMATELY TO CATCH THOSE WHO RUN THE LIGHTS? NOT ON YOUR LIFE. IT IS FOR THE, "FUTURE BIG BROTHER" TO WATCH AND CONTROL YOU. America had better rise up you can see the hand writing on the wall. We need to Impeach, Muslim Husain and Nancy Panokio needs to be removed. Two big controlling Demons who do not care about what the American people want. They have their own agenda I believe the title is, “BANKRUPT AND DESTROY AMERICA.” God help us.

It's done lets move on and give it a chance. Lets find what works and make it stronger and find what doesnt and fix and improve it. let's move on to wall street and help American's get back on there feet.

Kelly   March 23rd, 2010 9:29 pm ET

In my state, we are required by law to purchase automobile insurance and fined if caught without it. What is more important, your car or your health? If imposing laws requring insurance is illegal, can we get rid of the auto insurance law? Bet there are insurance lobbyists for that one too.

Ann-Virginia   March 23rd, 2010 9:30 pm ET

I am ashamed to say that the Gov.that was elected in Virginia by the "tea party"is one of those who has filed suit, wasting no telling how many taxpayer $$$'s before it's over.Did I miss something,or is Gov.McDonnell closing schools all over Va.because he has so much in the budget he can fight the Federal govt.over HC,but can't keep schools open. These suits are a waste of time & MONEY for states who can't afford to do this, plus it's a wakeup call for America to see the Republican party for who they are..fools & liars.

The current bill past by the democrats, I believe will cause a rationing of health care.It will flood the capabilities of current number of providers.IT will increse substantially number of people on medicaid which most drs will not see, since reimbutsement rates are much too low..I know many drs and large majority do not support the present bill. I think obama was myopic, clearly our major problem was our economy and jobs. This problem created our current crisis, not
our health care issue.Yet Mr Obama spent essentially all his time and effort on health care,If he had spent half his time on the economy maybe unemployment would not be>10%,and foreclosures would not be rising, and houses not selling.WAKE UP MR KING and MR OBAMA

People are realizing this whole NO Crowd is just a small minority of loud ruling class gangsters.

mtobin   March 23rd, 2010 9:45 pm ET

mitt says the republicans want to reform health care. When? Bush was in for 8 years. Why didn't they do it then.
The cost of healthcare increases 17 to 20 percent a year. Small business cannot afford those kind of increases.
I am glad somebody is doing something. This plan may not be the best but at least the dems are doing something.
The republicans keep saying they have better ideas. When do they plan on letting us know what they are.

Larry   March 23rd, 2010 9:45 pm ET

Baldwin, a true American Iconic thinker. A new low larry could of got lady GaGa I think..?...hahahaha

Isoline   March 23rd, 2010 9:48 pm ET

Its a great day for America. If president Obama didn't push for this health-care bill, that would be it for the less fortunate. The republicans dont care about the poorer class.. They are a disgusting bunch. Obama has a good heart. He puts the people before politics. Mitt Romney and the others need to stop badgering the president and find something to agree on. The American people need help. Its about the people of america. Not the politicians. When are they going to get it. The republicans had eight years. They almost bakrupt the country.

Ernie   March 23rd, 2010 9:48 pm ET

America is not mad or upset about the passing of Health Care Reform, on the contrary, everyone in America should have access to health care. America is upset that they have no choice in the matter. We will have to pay for health care whether we like it or not, or be penalized. The government is removing the "Freedom of Choice" from the American people, and that is the problem.

The words "Freedom of Choice" is what is at risk here – get it! This is the first step towards the government forcing you to "do" or "else."
Social Security is a contribution, if I don't work, I do not receive retirement benefits. If I don't want to drive my car any more, I don't have to buy car insurance. With health care it is forced.

The government is forcing you to do something – a violation of our Constitution!!! Stop missing the forest for the trees. America wake up!

mtobin   March 23rd, 2010 9:55 pm ET

and we are listening to Steven Baldwin why?

Paul   March 23rd, 2010 9:58 pm ET

It is truly a shame that Republicans have put partisanship above the American people. We are sadly lagging other world leaders. This is the first positive step we've taken in 40 years. I would rather have government "death panels" than insurance company death panels, for whom the ONLY motivation is profit. The distortions being propagated are unacceptable, yet they continue. I think the press has given far too much attention to conservative reactions that are clearly NOT based on facts.

Larry   March 23rd, 2010 10:00 pm ET

They forced car insurance and to this day If I drive a twenty year old car who benefits..? The person who drives the new mercedes..rite I support anything that helps Americans with there helth care worries.

aliou Florida   March 23rd, 2010 10:03 pm ET

Crist the do nothing florida gov. is one of them. If you had to wait for Charlie to do anything for americans, he would do exactly do what he's done for florida: Banckrupt it. Right now how many republican states are banckrupt? Unemployment in florida is one of the highest, and guess what? So too, the foreclosures and you know why? The people are unemployed. !! Go republicans, we know exactly what you want for our nation: Tax cuts and wars.

sheila crone   March 23rd, 2010 10:04 pm ET

I do not think that obamacare is a victory for the USA. We need health reform, but we don't want big government and we certainly don't want a lying president. Stephen Baldwin is correct in saying that Obama is a liar. A liar is not just words, but it is professing one thing while doing the opposite. Both parties are ridiculous. But one thing Americans know and that is we don't want to be like western Europe; ie. socialists.

jo   March 23rd, 2010 10:08 pm ET

What is the GOP bringing to the table beside hateful and contentious attitude. You lost the election and your attitude is not helping. Not one of you will take a stand on Rush Limbaugh, Glenn Beck, tea-baggers or the birthers. You stand for nothing and it's very obvious.
The only people I see working are the Democrats; the GOP decided they will approve NOTHING so why are you showing up for work? There is no intention to do anything but obstruct.
Next time I'm in the emergency room, I'll ask people what party they're aligned with and if they have insurance and if not, how are they going to pay for that visit. I had a colonoscopy and my insurance company would not pay for the anesthesiologist. I had a mammogram and they would not pay for the reading of the x-rays. I'm blessed and pay for my insurance out of pocket, but what kind of nonsense is this. I spent hours with my insurance company to no avail.
We need help from people who will listen. To the GOP; take your blinders off and take the plugs out of your ears and listen to people.
And stop with the threats about November. People will remember what you're doing. I know I will!

GoodMichelle   March 23rd, 2010 10:16 pm ET

Facts-The bill will be a baby-killer. Dem congress is corrupt and dishonest. Majority American people do not want this HC bill. Joe Biden needs to be censored for having a filthy mouth. Nancy Pelosi is a disgrace to womankind. Bart Stupak is nothing more than a pawn.
Gov't that changes the rules like children do in recess. Ignorant uninsured liken benefits to Christmas. IRS has no business deciding who gets what type of Health Care. Bailouts were more important than the Health Care of Americans. Barack Obama is not competent to be in the position of president and should know how Eecutive order
works. Barack Obama only wants payback and vindication by driving this country in the ground. He is not of American heritage. All Dems should be considered vile if they voted Yes or No to eradicate problem of the lack of trustworthiness.

Jim Nolan   March 23rd, 2010 10:18 pm ET

It surprises me that we can bail out the financial institutions when due to mismanagement they get into trouble. We can go half way around the world to kill an Irocie or an Afgan at a cost of billions of dollars at a moments notice. We can provide relief to any and all countries within 24 hrs of a catastophie. But, we can't provide relief to New Orleans in less than 5 days in an emergency and we can't provide decent health care to our own citizens. Can someone tell me whats wrong with this picture. The only thing I can figure out is the people deciding our priorities are mindless. Jim Nolan Warsaw, In

coe   March 23rd, 2010 10:20 pm ET

I thank you for the way you're approaching this topic of health care. You are exposing the grind of ignorance embedded in our elected officials.

Donna Jack   March 23rd, 2010 10:29 pm ET

Larry I watch your show every day, and tonight is the worst show I ever seen tonight,The American people can't be happy with a win like health care you have to call each other down. I guess saying baby keller is the way americans act in office. We would never do that in Canada, we have good helth care and we pay for it in taxes.

Fran J   March 23rd, 2010 10:38 pm ET

Ann Virginia, I was wondering the same thing about the cost of this law suit. It isn't gonna matter; in the end it will fail. Remember the Clinton days? the only thing we found out is that he was cheating on his wife & the tax payers had to foot the bill for that witch hunt. I don't know who CNN and the others are polling, but I am very happy with this bill and the President. God Bless the change that has come to America

sheila crone   March 23rd, 2010 10:38 pm ET

Why should citizens who can afford health insurance be penalized? I have many chronic health issues and if not for my health insurance that I pay for, I would either be dead or broke or both. Something's wrong with this plan. And what is a "cadillac plan?" What's fair about penalizing someone who has worked hard and been frugal while our buddies are pleasing themselves? Many of you accuse Republicans of not caring for the poor, but it seems that Obama wants to take what is not his to take. By the way, if you think Democrats care for the poor, you should wake up. They care about votes and staying in power. Neither party is good for the USA. Republicans have embarassed themselves. This is so disheartening.

yoyolite   March 24th, 2010 12:48 am ET

Dr. Gary I think that you should make use of the mental health part of the bill and seek help. Your hateful tea bag rhetoric is as offensive as I believe you are.

Marie Kohlhorst   March 24th, 2010 1:18 am ET

I'm so angry about this bill because I've paid insurance premiums for decades while the number of people getting freebe government handouts has kept growing and growing. It feels like the moochers have won...again. I don't want anyone dropped from their insurance due to an illness. Things such of this is wrong and needs fixed, but not everything is broken with the health insurance system. I realize there are poor or truly disabled people who need assistance, I've no objection to helping those who truly need it, but I work in healthcare and I'm sick of the abuse of the system I see everyday in the emergency room by lazy, ignorant people who have child after child after child they cannot afford but for tax dollars. I feel this bill only encourages and enables more of this behavior. I've never held as much disgust for the government as I do today.

I tend to agree with Jim Noland for the most part, not that I would begrudge any of the aid to catastrophy victims,. But, we also need to ry to protect our own victims, too. Victims of poverty, many whho are in poverty because of people who creat poverty because of their personal greed. If Both sides of the isle had given cover some of the deficit, the money they spent haggling over health reform and trying to defeet what ever Obamma tries to do, some of the deficit would evapporrate.. .Let's face it Representitives and Congressmen, CEO's rtc., if you are one of the highfliers and everybody made it to the top you and other high fliers wouldn't have anyone to clean your john. Don't look down on the American working people nor the ones who are disabled in any way through no fault of their own
. The way the economy has been going down the past decade you may be one of us.

Leona Henderson   March 24th, 2010 2:11 am ET

Got me started, so just got to say what I believe/... takes me awhile as hands stiff and eyes old, :

Many of the people who did not come forward who were, in their hearts, thinking that health reform is needed , were afraid of coming forward and admitting it as many of them have Republican bosses and possibly afraid of loosing their jobs.

Hugh in California   March 24th, 2010 2:31 am ET

Republicans continue to live in the past, which is why the majority of the American people know better than to fall for their subversive tactics of slander and name calling. I am totally shocked that so many people are vehemently against this health care legislation, and continue to voice their dismay with anger and malice, when our nation is finally ready to treat its citizens with the common decency that other nations have already given its people far in advance of our own.

Theresa   March 24th, 2010 2:53 am ET

This is a prime example why NOTHING gets accomplished in the US gov't. It's like the legal system.....verdict is in ...then the appeals begin. I'm Canadian..felt great pride for my American neighbours when Pres. Obama spoke before the signing of the bill. He impresses me that he doesn't give up...I honestly didn't think health care was going to pass. I thought when Scot Brown was elected Pres. Obama was going to push to the back & focus on job creation because that would've been more popular. Guess what ..he fooled the masses. You should be proud in the fct that he cares for his citizens & doesn't go the way of what the opposition demands...he does what he thinks every citizen has a right to expect.

Theresa   March 24th, 2010 3:04 am ET

Once again Dr. Gary you're spewing that racist rhetoric & once again you're fortunate that you live in a democracy & are allowed your mean speeches. It is very sad to have to read your vile comments filled with hate. You fit right in with some of those Republicans, Tea Party movement. members. I'm certain you belong to Rush Limbaugh's. Glen Beck's, & Sarah Palin's fan clubs. I've heard dear ol' Rush is planning to move to Costa Rica since health care has should go help him pack since the 2 =of you have the same thoughts. Hey, why don't you @ least join him in Costa Rica for a 2 wk. rest..... I know I need a break from your vile comments.(yes, I know there is freedom of speech!!!)

A. Smith, Oregon   March 24th, 2010 3:28 am ET

Employees are already legally obligated to pay Social Security and Medicare taxes. And these Republican Attorney Generals are going to burn up Hundreds of Millions of dollars in State revenue's that are literally on the brink of bankruptcy in a failed attempt to overturn America's Health Care bill thru the US Supreme Court.

I watched C-SPAN this past Fri-Sat. as the Democratic Congress lady from Guam brought forth legislation honoring American veterans that fought and died in the South Pacific and also legislation honoring American veterans that served during the Cold War.

I was deeply disappointed as Republican Congressmen repeatedly interrupted, obstructed, and made a fool of themselves as they tried over and over again to inject debate over the upcoming Health Care Bill in the midst of the entirely different legislation meant to bring honor and rememberance to those brave Veterans.

Now it seems the Republican party are going to make a fool of themselves again before the US Supreme Court. Unfortunately, they'll use State funding from Public Schools, Police, Fire and Public services to pay for their futile efforts causing more people to suffer.

Does the Republican Party care if they cause more people to suffer? NO, it appears they only care about their Corporate masters profit margins.

mary u from ohio   March 24th, 2010 8:14 am ET

They just don't want it cause that means the states has to dish out money to human beings...
When we get sick....
But I sure them and their friends have insurance...
Again they don't care about us...
People are denied Insurance cause of health.....
Do they believe in saving lives???

You Know!!

Some "MORONS" never know when they've lost.

It's like the blind leadind the blind.

They just stumble along banging their heads together, wasting tax payer dollars on frivolus idiocy, and swell their inemic chests up and posture like the farmyard COC all noise but no effectiveness.

How on earth can itelligent people elect those BOOBS.??

I know! They're to be pitied because they are REPUGNACANTS.

Gerald Jolly   March 24th, 2010 10:40 am ET

Really folks, should the REPUGNACANTS be allowed to spend even one dollars os State Tax Dollars on such an idiotic scheme, when we all know that most of the States that are fighting against the health bill are already in the "RED" due to their mis-management of the State Budgets.

The REPUGNANT way, close schools, lay off your police force, allow roads to deteriarate, but spend spend spend because they dont want to accept a legitemate act of congress.

So what's new with these SWINE HOUNDS.

major barnett   March 24th, 2010 11:40 am ET

The issue surrounding the health care bill is, a lessening of the norms. Some citizen don't see our president as being the norm therefore find it easy to violate social norms with having tea parties, john lewis being called the N word, others being spit on and politicians yelling at the president-you lye. Therefore will not be seen in the same view as past presidents who were white, and so he will be treated different.

I think the comment I heard from a civilization historian was true. This is par for a civilization that is on the fall. The "socialism" ideology is the beginning of the end. All the Obama supporters are afraid of is that they have to admit now that they made a mistake. I will forgive you if you get your head in the game and stop this takeover. Obama has not done anything for you yet but attempt to further his agenda which is NOT caring about you guys. WAKE UP and smell the tea! This is his best attempt to transform the United States of America into what he always thought is should be. I have read some of Obamas attempts at writing. I will tell you he sounded alot like the bumbling idiot beside him the other day with the language he uses. Let me tell you. You need to work for what you get and stop looking for "Christmas" to come from DC. On Violence- no- Americans who want to defend the constitution can manage to right the wrongs committed by those who have little integrity if any and are willing to KILL babies-yes -I said it -what else would you call it! Stupak wanted his 15 minutes. I am doing my part to be active in making my voice heard and this is not how. This just makes me feel better. What works is getting out and making a difference, so gotta go. Go read the Constitution and if you disagree with it then get a one way ticket OUT.
