Did You Think Michael Jackson Would Stop Being Involved in Lawsuits?

art.jackson.skin.grammys.giMove over, death and taxes. Litigation involving Michael Jackson is yet another inevitability we can set our clocks by.

The late singer's estate is embroiled in two new lawsuits, one filed today in federal court by Jackson's administrators against the Heal the World Foundation and its affiliated corporation for allegedly trying to trade off of Jackson's name, his song and other terms unequivocally associated with the King of Pop.

Terms such as, "King of Pop."

Heal the World and United Fleet have been trying to "deceive the public into assuming they operate Jackson charities and thereby obtain contributions from Michael's fans who believe they are making charitable donations to a legitimate Michael Jackson organization," reps for estate administrators John Branca and John McClane said in a statement.

This Rabbi is acting as if he is doing some type of service or good thing by putting out this book. I think he just wants money. I f he doesn't he should let all proceeds from this book go to a children's charity.

Of course not. Creditors will sue the estate. The Estate will sue those that infringe upon it or exploit Michael's image and legacy. Maybe soon we will hear updates about the investigation.

Please, don't mix apples with oranges. The lawsuit against HTWF is filed in a federal court and the estate administrators demand a jury trial to solve their complaint. In contrast with that, claims regarding unpaid bills and debts of MJ's estate have to be filed in the probate court. It's a normal thing when a person dies and their debts are settled. The same probate court that has to approve all business deals for the estate and the allowance paid to MJ's mother and children. This may happen until the probate process for MJ's estate will end, after a year or two.

Actually – as we all know, if Michael had not been so nice and responded/sued more people for their disloyality, dishonesty etc, the estate might not have to go so far. They must now go after everyone that will tarnish Michael's image. I say – about time and get it all done. I believe before it is all done, the Rabbi will also have his turn with the estate.

I know for a fact that there are many other suits/injunctions out there on other organizations and individuals. As Hollywood/California knows, MJ has the best in the business with Branca. Time will tell.

When are Branca/McClain going to sue that scam artist Shmuley. They should really looking into his claim that Michael agree to write that book. There should be a contract or consent forms from Michael regarding the sale of this book. If there is a contract the estate should be receiving money as well from the proceeds. Profits should be split 50/50.

Why did these little lechees think they were doing trying to extort money from people using MJ's name ??? They have to be sued, and really sued BIG TIME. To Celine -FR – I am fine, but I find it interesting that Michael hired them back if they were loyal to Sony. What's the scoop? I have only heard in the legal arena that they are great lawyers in estate matters concerning the music industry. I work in estate matters with a CPA firm and so have found this aspect of Michael's life somewhat interesting to follow.

but as you know there was lot of problems between Michael and sony

read this :

Many years ago Michael was waiting for the licenses to the masters of his albums to get back to him, so he could promote his old music and prevent Sony from getting a cut of the profit.

Michael expected this to occur early in 2000, however for unknown reasons this didn’t happen

so M.J began an investigation, and it emerged that the attorney who represented him in the deal was also representing Sony, creating a conflict of interest
– he was working secretly for sony and leaking M.J's business secrets to them –

in other words he was misleading and betraying Michael

I think that’s why Mrs Katherine is disapproving and contesting Branca ‘s administration of the estate

Obviously he’s taking advantage of his position as a will executor to serve sony’s interest

I’m pretty sure Michael did some revises in the will concerning the executors especially after the 2005 trial

For a number of years, Sony had been negotiating to buy M.J’s music catalog.

If M.J’s career or financial situation were to deteriorate, it would be in Michael’s financial interest to sell his catalog.

That’s why Sony has something to gain from Michael’s career failing

and that’s why I think Mrs Katherine want to remove Branca and McClain

Otherwise Michael’s estate will be bankrupted, therefore Mrs Katherine will have no choice to save the estate but to sell M.J’s part of the catalog

Thanks for sharing this story. There is no doubt the two executors, Branca and McClain, are doing a very good job as of now with administering the estate.

But I've always looked at the whole issue of Katherine probably wanting to change them as something to do with saving MJ's estate in the long-run. I mean if there was already a conflict of interest somewhere involving part of the preservation of the estate whilst MJ was alive, then there is a reason for Katherine to be suspicious anything can happen onetime.

The reason as to why MJ brought these two men back into his Will, especially this Branca, is one other puzzle which is still lying infront of me as well. There is a perception by some people or fans who think maybe there might be another Will somewhere, which could possibly reveal something else about the two being given that further chance as executors. But if that is the case, where is this Will ???

As it was revealed previously by one member of the family, i think its also Latoya if I'm not wrong, MJ usually reviewed his Will every 5 years, which means if the existing Will was reviewed in 2002, then one would expect or think he could have reviewed or made a new Will in 2007.

However, i also remember somewhere the last weeks reading an article which said someone, I forgot the name, had also stated that somewhere around 2007, she/he had approached MJ on more than one occassion to make him aware of the fact that maybe he could need to do some changes in the existing Will, but MJ kept saying he was quite okay with the existing Will as it was. I remember that person even pointing at the fact that the Will was same as the one from 1997, and the only difference was the inclusion of Blanket. So, does this mean the two executors have been in that Will as back as 1997 or even more ???

Branca had been with Michael since the 80's, I believe. I think you are right about the Will being the same as the 1997 Will. Would that have been Michael's manager, Dileo, maybe, that addressed this on LKL? I remember something about that and him speaking to the validity of the Will. Being in a business where we handle people's money, I am shocked that Michael did not have better people around him handling the money. Or who knows, maybe he did and the media just continues to find some way to raise questions about Michael. Anyway, it will be a very long time until this estate will be settled...a very long time.

This very deception by "Heal The World" almost worked on me!! if it wasn't for Lori and Patty( thanks ladies!) knowing the deal with them I would have joined. It did very much appear on their website that they were continuing MJs work. I think it is a very legitimate lawsuit. Instead I decided to sponsor a little boy in Kenya, Africa and I think it was a good decision and if it weren't for MJs music, I probably would never have gotten involved.

MJ wanted to change the world and I think he did it! 😉

Right, it was Raymone Bain, MJ's former general manager, who said it on Geraldo. She said she asked him twice in 2007 about the will, the second occasion being when they refinanced the debt backed with the Beatles catalog.
If MJ was convinced Branca had betrayed him for Sony, he would have had plenty of time to change his will between 2006 (when Branca left) and 2009. And he would have never rehired Branca.

I guess he felt the need to reunite his old "golden team" from the years when he was the happiest (and the richest) – Branca, DiLeo, Karen Faye. All of them were rehired weeks before his death.

I think one thing about MJ, he had some way of reconciling with his aquintances whenever they had some misunderstandings or disgreements in their business deals or relationships. For instance, I think this seems to be the case between him and Branca, as well as between him and DiLeo. That to me also is a good indication of the goodness in MJ, unless for those I think who really hurt and did things to him he knew he would never forget.

On the other side, MJ was really faced with a big problem of who to trust. I think the fact that he ended up taking or having to reconcile with his old aquintances was that he probably saw it better to take or do business at least with those he already knew........you know how difficult it is to strike that relationship especially businesswise with someone completely new ???? Thats why I tend to believe maybe its the reason MJ turned again to Branca, coz he knew him for quite a long time, and Branca is evidently someone who is good anyway, at his job.

As much as I've previously expressed my understanding for Katherine's need to change the two executors, I still have those reservations that Branca especially could possibly not be a bad choice as an administator for the estate coz MJ himself turned to him in his time of need, which is when he went into his plans for this failed tour.
I also remember reading that Branca even made a comment that when he resigned as MJ's executor in the SONY/ATV, he did it at his own accord, and MJ never asked him to resign nor did he ask him to stay. MJ could have definately trusted him somehow to run his businesses.

This is so interesting and Cocovelvet I really like what you said about Michael being able to reconcile with those he had differences with. Really a special guy and to Boteach I would like to say that that would be humbling oneself when Michael brought Branca back. And I agree about Branca being a good choice because he is extremely well thought of in this particular area of law. Thanks for a good chat. You all have taught me alot.

That's right, Cocovelvet – Branca said they parted ways amicably and he left because he was unhappy with other people who had started to gain influence around MJ at that time (after the trial, in 2006 – I remember various sources saying that after the trial many of MJ's old people have left and new ones came in). Nothing unusual, I'd say.

As for Branca's competence, I think he was among the very few people around MJ who have been good at their job. And he was always a wealthy lawyer – didn't need to steal money from MJ.

Yes, Maria.......

Branca exactly said that he left coz MJ was suddenly surrounded by people who didn't have his interest at heart. I remember that at some point discussed in the blogs that Branca might have referred to people like the infamous Tohme Tohme, just to name a few.

We should not forget that MJ was a world superstar and those around him wanted to have that little piece of MJ. I see a situation where all those who were or wanted to brush shoulders with MJ , had to even act like snakes on each other. I think in that respect, Branca must have seen it necessary for him to give way as he appears moderate, and a person who respects himself to be involved in those dirty games. Thats why he probably chose to leave those vultures to bite each other for that last piece of whatever they could lay their becks on.

Well, Jan, that's the problem – you may want Tom Mesereau to be at the table, I may want Tohme (joking of course), someone else may want Oxman or Geragos and so on. But none of these persons was nominated by MJ in his will. Remember that initially there was a third executor, Barry Siegel, who resigned in 2003. So MJ had at least 5 years to replace him with another person – a member of his family or a lawyer. He didn't do that.

I have been waiting for this. Heal the world foundation had nothing to do with MJ anylonger. They might do a good job and it might be for a good cause but it is not Michaels foundation.

Im also very happy Branca and McClain is taking care of the estate. No matter what people say about them. They are the ones closest to know what Michael wanted and how to get there.

A month ago, Ian Halperin said on Paris Match that the $5.5 million news alerted Katherine, who started to suspect there are much more money involved. Halperin claims Katherine wants to sue Tohme and other handlers for embezzling no less than $600 million over a period of 20 years.
I don't like Halperin, I'm not sure about his sources and the sum is HUGE, but probably Tohme pocketed indeed a larger sum than $5 million.

Halperin is not a reliable source, even Michael knew about him and had to deny his saying last december :

Mr. Jackson is in fine health, and finalizing negotiations with a major entertainment company and television network for both a world tour and a series of specials and appearances."

well I really think that Michael was not in total control of his life especially after those terrible accusations and trials in 2005

many people said that there was some suspisious guys arround him in that period of time
so I beleive it wasn't his own decision to bring back Branca

about the will : I really don't know but I think if there was a new will it should be with his lawyers

but again you know sony are really a big thing in music/film industry

and money and corruption can buy anything and everything these days

and lately it occured they -sony- were corrupting and giving bribes to radio stations in the US
and as you know they banned M.J music in america after Invincible when he accused Motolla -sony's boss – of racism

Michael was always very smart, he knew who his real friends were and which ones just wanted money and didn't care about Michael the beautiful person that we know he is. He always was seeking the truth and it did result in lots of lawsuits. These bogus charities were started by hateful people profiting from Michael's death, knowing the fans would be extremely generous and support Michael in every way, just as he always suppored honesty and truth. JUSTICE FOR MICHAEL.
