Perez Hilton 'could face child porn charges'

Posted: 01:35 PM ET

Via.CBSNews.com

Perez Hilton might be in some hot water after posting an uncensored photo of  Miley Cyrus' private parts to his Twitter account.

Early Monday morning, Hilton posted a picture of the 17-year-old pop star wearing a short white dress and no underwear. In the photo, Cyrus is in the midst of climbing out of an open-topped convertible car with her lady parts exposed.

For his two million plus followers to see, the celebrity blogger posted the picture with the following introduction, "If you are easily offended, do NOT click here. Oh, Miley! Warning: truly not for the easily offended!"

But it's the celebrity blogger that might need a warning. Cyrus is underage. Police might consider her naked image child pornography.

Recently, Cryus has been facing a barrage of criticism for being too sexy due to skimpy concert outfits and her edgy single, "Can't Be Tamed"

It is unclear if Hilton will face any legal trouble, but he might be setting himself up for yet another celebrity feud.

Hang him. He's a cyberbully and a pornographer.

A reasonable person   June 15th, 2010 1:56 pm ET

Wow, not only has Perez has hit a new low, but this does seem like a criminal offense. I hope the authorities take a look into this. It's very creepy.

kd_whitford@hotmail.com   June 15th, 2010 2:20 pm ET

Perez Hilton should be charged criminally for his actions. This D-Bag makes his living publishing crap and he should have to pay the piper for skirting the law. Publicity at any price....the bill just came due, Perez!!!!!!!!!!!

dansgirl   June 15th, 2010 2:35 pm ET

He needs to go to jail looks like KARMA finally got him!!!!!!!!!!!

Ted   June 15th, 2010 2:51 pm ET

Posting a paparazzi photo of a celebrity who decided to forgo underwear in public is not pornography. It was in bad taste, illegal in some countries (but not all, where 16 is the age limit), but calling Perez a pornographer is ridiculous. MIA's "Born Free" is vastly more disgusting.

1luckydogpaulmichael   June 15th, 2010 3:07 pm ET

What is wrong with that man. He should be charged and prosecuted to the fullest extent of the law!

byebyeperez   June 15th, 2010 3:15 pm ET

GOOD! SHUT HIS SH*T WEBSITE DOWN!

Darian   June 15th, 2010 3:47 pm ET

The government (Both federal and State) should charge Perez Hilton with child porn charges. Miley is 17 years old and a child. Put him in jail. He is a sex offender because posting things like that of kids makes you a sex offender. Sex offenders belong in jail.

Mike   June 15th, 2010 3:47 pm ET

Whether you like him or not, or like Miley or not, what he did IS against the law. If it's her or another 17 year old, putting images of any under age girls lower region exposed is against the law, and should be dealt with legally. He also posted a rather disturbing video in response to these charges, which mocks the entire thing. He is a pathetic person and I hope he goes to jail for a very long time.

Robert   June 15th, 2010 3:48 pm ET

The question that has not been raised yet, is if the photograph that Hilton allegedly posted would actually constitute child pornography in the legal sense of the word. Many US laws, for better or worse, make distinctions between 1) child pornography, 2) child erotica, and 3) non-pornographic/erotic images of children such as family snapshots of a toddler in the bathtub or photographs used in a pediatric textbook. While child pornography is illegal, the latter two categories are often protected under the first amendment (despite any moral objections that one, like myself, may have to the idea of so-called child erotica). Simply depicting the genitals of a minor may not necessary be considered child pornography in a US court of law.

PaulieNIowaCity   June 15th, 2010 3:51 pm ET

It may not truely be child pornography, but if teenage boys are being charged with child pronography for sending their little girlfriends a picture of their private parts. He should be charged for posting a pic of Miley. No matter what you may think of her, she is only 17 years old. If she wants to put photos of herself out there like that. That;s her right, but for someone else to put them out there, that's illegal.

heni   June 15th, 2010 3:55 pm ET

A child celebrity is still a CHILD meaning not an adult meaning you do not take pictures of her parts and display them its that simple.. hello remember JonBenét Ramsey i know her case was vastly different and ramsey was much younger but pictures of little girls acting like adult women with slutty clothes and stripper makeup society needs wake up and to stand up against this. Don't let Our daughters just be some meat on some guys meat

B   June 15th, 2010 4:03 pm ET

I do not consider this to be a pornographer's action (he doesnt exactly meet the criteria for a pedophile either). The paparazzi (I think they are wrong for what they do) took this photo, and happened to snap this shot.

It should have been deleted immediately. Shame on the photographer.

Perez posting this was in extreme bad taste, and an overall stupid decision. He should face a penalty, and it should cost him his website. He made a choice that effected a minors life.

This is what he gets for always pushing the line. I dont wish ill on anyone, but I have a hard time not thinking he didnt have this coming.

KC   June 15th, 2010 4:21 pm ET

First of all, does anyone not see anything wrong with a 17 yr walking around in a short dress with no underwear!!!!! That girl is out of control and on her way down the same road as Lindsay Lohan. Watch my words.

AndyW   June 15th, 2010 4:22 pm ET

Would LOVE it if this scumbag ended up having to register as a sex offender for the rest of his pathetic life.

Kirk Patrick   June 15th, 2010 4:30 pm ET

Commie wrote: "Hang him. He's a cyberbully".

Is Commie that much of a Miley fan that he actually quotes Miley Cyrus propaganda ads such as her Cyberbullying commercial? The Cyberbullying act is an attempt at taking away the First Amendment. And now we execute people for "cyberbullying" (defined as hurting an especially wimpy persons feelings) Isn't Commie's comment "cyberbullying" if they recommend killing someone? Oh wait, it's selectively enforced to prevent anyone from criticizing the status quo.

Kirk Patrick   June 15th, 2010 4:32 pm ET

Girls who wear no underwear (and especially those who also shave) leave behind a trail of schmegma wherever they sit. These girls define scuz.

THX   June 15th, 2010 4:33 pm ET

I would've thought Miley would have waited till she was 18 to start flashing the photogs her goodies ala Britney Spears. Not a surprise really though. After the pole dance and the magazine cover, this is the natural progression. Next she'll be boozing it up with Paris, Lindsay and the rest of Hollywood's waste-oid bims.

LK   June 15th, 2010 5:04 pm ET

Maybe this will encourage Miley's parents to do some actual parenting. And isn't indecent exposure against the law as well? Perhaps both Miley and Perez should be charged.

Leslie   June 15th, 2010 6:23 pm ET

You guys are missing the issue. The paparazzi did not take this picture, the one they took she was wearing underwear. Perez Hilton (or a "source") photo shopped a fake "lady part" onto it just to "break the story" and get hits on his site. He is a sick, sick man!

IMD1   June 15th, 2010 6:50 pm ET

That 's is so weird I thought he was gay? Maybe there are skeletons in his closet that did not come out when he came out.

Cindy   June 15th, 2010 6:57 pm ET

Miley's lack of proper attire is inexcusable. However, Perez is a pervert. Most didn't need this incident to know that.

Kayladnd   June 15th, 2010 9:04 pm ET

WHO TOOK THE PICTURE – shouldn't they be the one getting a little arrested too? I mean they shot the picture UP a teenagers skirt!!!

Gendarme   June 15th, 2010 9:46 pm ET

Yes, Perez is a bottom feeder, seeking fame any way he can snag it. I suspect there are some issues to be addressed about him using her likeness without express permission, but that is the least of his problems. She is underage and yes, she ought to be more circumspect in her behavior. Regardless, any scumbag can alter a photo of YOUR toddler, pre-teen/teen at the beach and then use it for illicit purposes. His intent to discredit her for the titillation of other similarly demented individuals is just more evidence of his desperation to be "somebody." Major Fail, Perez!

rita brown   June 15th, 2010 10:15 pm ET

The fact that he deliberately photoshopped the picture to LOOK like she had no underwear makes it even worse. Please put this low-life in jail where he belongs, and maybe the inmates can give him a taste of his own medicine. It doesn't matter if you like Miley or not, this isn't even about her specifically. Selectively applying the law only to victims that are thought to behave appropriately is basically taking step backwards into the early 20th century. "Well, she is a whore, so she deserves to be treated as such". Such a mentality is setting the precedent for victims of sexual exploitation to not be taken seriously because some judgmental people believe that only "certain women" are worthy of protection. And at the end of the day, Miley is a kid, no matter how grown-up you think she acts. There are many teenage girls out there younger than Miley who dress and behave a whole lot worse than she does, yet everyone picks on Miley as if she is the ONLY one. If you have a problem with her behavior, then it's worth considering that children don't raise themselves. 17 year olds make mistakes, that is perfectly normal. What's not normal is for people to act all high and mighty and laugh at her when something like this happens.

Well, Well ... I guess there is a Goddess in heaven and shes pissed at this A__ Hole who goes around posing as a reporter, celeb and a human. I hope he is made an example of what happens when you cross lines of taste and common sense.

Sandee   June 16th, 2010 2:07 pm ET

Well, what would be more interesting is finding out where Cyrus was at the time...was she outside a club...was she drinking at that club...great role model for the teens in this country! Cyrus is a spoiled brat who is veering off into Lohan territory–good riddance. Perez is scum but so are most of the fame-seekers in Hollywood. Hard to believe it's also the town of a lot of hard-working professionals, who find it possible to stay out of the tabloids!

jennifer tormis   June 17th, 2010 1:33 am ET

I Don't Like Miley But she is still a littel a girl and Prez nobdy Hilton was doing is Sick and preveted and I hope he ends up in jail

Robert Daniel   November 30th, 2010 6:22 pm ET

Aw man...what is this I read? It is sickening that this guy would do such a thing to Miley Cyrus who is precious to me!!! I am feeling sick right now. I stand up for my GOD because this is something that needs to be addressed for everyone to hear. GOD is forgiving and gracious to those who receive His LOVE, that is JESUS CHRIST GOD. Everyone is "free" to do whatever but will give an account one day for what he felt was "right" to do at the time. Why is someone snapping an inappropriate pic of someone GOD truly loves and cares about and someone who belongs to Jesus making her my precious "sister" in GOD? It is because the one snapping the photo does not care if he spits in GOD's face by him choosing to snap my "sister" in GOD's family's privates. I pray God rebukes and stops all her enemies. What I have published is the idea of what God has written forever in His Bible (His love and care letter to His creation-man)-if only they would help themselves by asking God to help them apply what is written there to lives "one bite at a time".But they don't want to so they cause others to do something "harmless". Are you kidding me it is wrong!!!!!!! I have felt compelled by my conscience to publish my feelings on this and encourage other like-minded individuals to do the same.
